1. About These Terms

These Terms of Service (the Terms) govern access to and use of BookGolfDirect Spain (the Service), operated through bookgolfdirect.com. By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. The Service

BookGolfDirect provides an online directory and enquiry platform intended to help golfers discover golf clubs and courses in Spain and contact them regarding green-fee availability. We may display information supplied by golf clubs, public sources, users, or other providers. Information may be incomplete, outdated, or subject to change.

BookGolfDirect is not the golf club, course operator, travel provider, or payment agent for a golf club unless expressly stated otherwise. A golf club remains responsible for its own availability, prices, rules, facilities, services, and customer communications.

3. Accounts and Acceptance

You must provide accurate information, keep your login credentials confidential, and promptly update information that becomes inaccurate. You must not create an account for another person without authority, impersonate a person or business, or use the Service for unlawful, abusive, deceptive, or automated purposes.

Account creation requires an affirmative checkbox accepting these Terms and acknowledging the Privacy Policy. We record the accepted Terms version and acceptance timestamp for account and compliance purposes. If these Terms materially change, we may require renewed acceptance before continued use.

4. Booking Enquiries Are Not Confirmed Bookings

A booking form submitted through BookGolfDirect is a request for a green fee or tee time only. It is not a confirmed booking, reservation, contract, or guarantee of play.

A booking becomes confirmed only when the relevant golf club communicates its acceptance directly to you and any conditions required by that club, including price, payment, deposit, cancellation terms, player requirements, and availability, have been agreed. You are responsible for checking the club's response and complying with the club's rules.

BookGolfDirect does not guarantee that a requested date, time, price, course, or facility will be available.

5. Payments, Credits, and No Refunds

Some golf-course managers may use credits to unlock customer contact details from booking enquiries. Credits are a digital service entitlement, not cash, stored value, or a transferable financial instrument. The applicable price and credit allocation are shown at the time of purchase.

Except where mandatory consumer law requires otherwise, purchases of credits are final and non-refundable. We do not provide refunds for unused, expired, mistakenly purchased, or unwanted credits, or where a golf club does not ultimately confirm or complete a booking. Credits may not be sold, transferred, exchanged, or redeemed for cash.

Nothing in this section limits any statutory right that cannot lawfully be excluded, including rights relating to defective digital services, fraudulent transactions, or applicable consumer-protection rules.

6. Golf Clubs and Course Managers

Course managers must only register or manage a club where they are authorised to do so. Managers are responsible for the accuracy of club information, the lawful use of uploaded images and content, responding appropriately to enquiries, and complying with applicable data-protection and consumer laws.

BookGolfDirect may contact a club about profile corrections, image permissions, booking enquiries, service updates, or account matters. Any promotional use of club images supplied from a club website requires appropriate permission from a person authorised to grant it.

7. Reviews and User Content

Users must submit truthful, relevant, and lawful reviews and other content. Reviews must not contain personal data about another person without a lawful basis, threats, hate speech, defamatory allegations presented as fact, advertising, links, or misleading material.

Reviews may be submitted for administrative moderation and are not published automatically. We may approve, reject, edit for formatting, or remove content that violates these Terms or applicable law. Approved reviews may be displayed publicly on relevant club or course pages.

By submitting content, you grant BookGolfDirect a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, and display that content in connection with the Service. You retain ownership of your content and represent that you have the necessary rights to submit it.

8. Privacy and GDPR

We process personal data in accordance with applicable data-protection law, including the EU General Data Protection Regulation where applicable. Our Privacy Policy explains the categories of data collected, purposes and legal bases, recipients, retention, cookies, review moderation, and your rights.

Where a booking enquiry is sent to a golf club, the information necessary for the club to respond may be shared with that club. You may request access, correction, restriction, objection, portability, or deletion of personal data where provided by law. Requests may be sent to info@bookgolfdirect.com.

9. Intellectual Property

BookGolfDirect and its original software, design, branding, text, and functionality are protected by applicable intellectual-property laws. You may use the Service only for its intended purpose and may not copy, scrape, reverse engineer, resell, or commercially exploit it without written permission.

10. Availability and Liability

We aim to keep the Service accurate and available, but do not warrant uninterrupted operation, error-free content, or availability of any golf club, course, accommodation, or third-party service.

To the maximum extent permitted by law, BookGolfDirect is not liable for indirect or consequential loss, missed tee times, changes in availability or price, club conduct, travel costs, or losses arising from a booking that was not confirmed by the club. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Suspension and Termination

We may suspend or close an account, remove content, restrict access, or cancel digital entitlements where reasonably necessary to prevent abuse, comply with law, protect the Service, address non-payment, or enforce these Terms. You may stop using the Service at any time. Clauses that by their nature should continue will survive termination.

12. Changes and Governing Law

We may update these Terms to reflect changes to the Service, law, or operational requirements. The current version and effective date will be published on this page. These Terms are governed by the laws applicable in Spain, subject to any mandatory consumer protections applicable to you. Disputes will be subject to the competent courts unless mandatory law provides otherwise.
